  3. END USER SUB-LICENSE AGREEMENT
  4. VIRTUAL PLACES (TM) CLIENT
  5.  
  6. CAREFULLY READ THE FOLLOWING TERMS AND CONDITIONS. THESE TERMS
  7. AND CONDITIONS ARE ACCEPTED BY DOWNLOADING THIS PRODUCT 
  8. AND/OR CLICKING ON "ACCEPT" BELOW. THERE ARE PATENTS PENDING 
  9. ON THIS PRODUCT.
  10.  
  11. Excite, Inc. ("Excite") hereby sub-licenses the Virtual Places client software, including
  12. the documentation, for use on a non-exclusive basis.  This product is licensed for a 
  13. single machine by running the Install script and accepting the terms and conditions of 
  14. this Agreement. Copies may be made solely to the extent that (1) the Install script is run 
  15. for each machine on which the product is run or Excite is otherwise provided with the 
  16. information required in the Install script, and (2) all proprietary notices are reproduced
  17. on each copy.  Disassembly and other reverse engineering of this product are strictly 
  18. prohibited.

  20. THE PRODUCT MAY NOT BE USED, COPIED OR TRANSFERED, EXCEPT AS 
  21. EXPRESSLY PERMITTED BY THIS LICENSE
  22.  
  23.                                     TERM
  24.  
  25. This license is effective until terminated. It may be terminated at any other time by 
  26. destroying all complete and partial copies of the product including backup copies.  
  27. This license will also terminate automatically upon conditions set forth elsewhere in 
  28. this Agreement or upon failure to comply with any term or condition. Upon such 
  29. termination, all complete and partial copies of the product, including all backup 
  30. copies, must be destroyed.

  32.                                    FEES
  33.  
  34. There is no license fee for the Virtual Places client software. This Agreement does 
  35. not grant you any right to any enhancement or update to, or support or maintenance 
  36. for, the product.
  37.  
  38.                                    TITLE
  39.  
  40. You acknowledge Virtual Places√≠ and Excite's ownership of all rights in the product. 
  41. Title, ownership rights, and intellectual property rights in and to the content 
  42. accessed through the product is the property of the applicable content owner and may 
  43. be protected by applicable copyright or other law. This Agreement grants no rights to 
  44. such content.

  46.                                 NO WARRANTY
  47.  
  48. EXCITE ASSUMES NO RESPONSIBILITY FOR THE SELECTION OF THIS
  49. PRODUCT TO ACHIEVE ANY INTENDED PURPOSES, FOR THE PROPER 
  50. INSTALLATION AND/OR USE OF THIS PRODUCT OR FOR VERIFYING THE 
  51. RESULTS OBTAINED FROM USE OF THIS PRODUCT.  EXCITE LICENSES THIS
  52. PRODUCT "AS IS" AND DOES NOT WARRANT THAT THE FUNCTIONS 
  53. CONTAINED IN THIS PRODUCT WILL MEET ANY REQUIREMENTS, THAT THE 
  54. PROGRAM IS FIT FOR ANY PARTICULAR PURPOSE OR THAT THE OPERATION 
  55. OF THE PRODUCT WILL BE UNINTERRUPTED, ERROR-FREE OR VIRUS-FREE.

  57. ANY IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF 
  58. MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND 
  59. NON-INFRINGEMENT ARE EXPRESSLY EXCLUDED.

  61. SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES,
  62. SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.  IN THAT EVENT,  
  63. ANY IMPLIED WARRANTIES ARE LIMITED IN DURATION TO 90 DAYS FROM 
  64. THE DATE OF DELIVERY OF THIS PRODUCT.  THIS WARRANTY GIVES YOU 
  65. SPECIFIC LEGAL RIGHTS.  YOU MAY HAVE OTHER RIGHTS, WHICH VARY 
  66. FROM STATE TO STATE.
  67.  
  68.                                   GENERAL
  69.  
  70. REGARDLESS OF WHETHER ANY REMEDY SET FORTH IN THIS AGREEMENT 
  71. FAILS OF ITS ESSENTIAL PURPOSE, IN NO EVENT WILL EXCITE BE 
  72. LIABLE FOR ANY LOST PROFITS, LOST SAVINGS OR OTHER INCIDENTAL, 
  73. INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, ARISING OUT OF ANY 
  74. USE OR INABILITY TO USE THIS PRODUCT OR THE BREACH OF THIS 
  75. AGREEMENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  77. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF 
  78. LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THE ABOVE 
  79. LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

  81. None of this product or underlying information or technology may be exported or 
  82. reexported into Cuba, Iraq, Libya, Yugoslavia, North Korea, Iran, Syria or any 
  83. other country to which the U.S. has embargoed goods. In the event the Federal 
  84. Acquisition Regulations ("FAR") or DFARS is applicable to this Agreement, this 
  85. product is provided only with "Restricted Rights" as defined in Sec. 52.227- 19 
  86. or Sec. 252.227-7013(c)(1)(ii), respectively, as applicable. Excite is not 
  87. responsible for paying any sales or use tax imposed at any time whatsoever on the 
  88. license of this product.

  90. THIS IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT 
  91. BETWEEN THE PARTIES RELATING TO THE USE OF THIS PRODUCT.
  92.  
  93. YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, 
  94. UNDERSTAND IT AND AGREE TO BE BOUND BY ITS TERMS AND 
  95. CONDITIONS.
